Terms & Conditions – Bluebell
TERMS & CONDITIONS OF SALE
These terms & conditions shall apply to ALL CONTRACTS between Bluebell Fitted Furniture and the Client and no variation of these terms and conditions shall be effective unless agreed in writing and signed by the Client & a duly authorised representative of the Company.
1. Definition in these terms and conditions and in all Contracts to which these terms and conditions apply:
a) “the client” shall mean yourselves.
b) “the company” shall mean Bluebell Fitted Furniture Ltd.
c) “the materials” shall mean MDF, MFC, ACRYLIC or WOOD.
d) “the goods” shall mean the furniture &appliances specified in the drawings.
2. The goods ordered under this agreement are purpose made specifically for the client’s particular requirements. The company reserve the right to retain an amount to cover the reasonable costs that we have incurred should the customer cancel the contract.
3. Terms of payment:
Where a client signs the contract on our business premises, we impose the following terms of payment. 30% of total order value on agreement of order and 70% of total order value to be paid 2 days prior to installation.
a) The price of this order/quotation is valid for product fitted within 90 days of the quotation date after which it may be subject to a review.
b) Cheques shall be made payable to: Bluebell Fitted Furniture Limited. Or online to A/C60645860 A/Cname – Bluebell Fitted Furniture Limited. Sort Code 30-95-42 (referencing your payment with your name and postcode) or by debit / credit card by contacting our showroom.
c) You can protect your deposit/payment by paying all, or part of it, by credit card, up to a maximum of £30,000, and we would encourage you to do so.
d) Upon signing by the Purchaser and duly authorised representative of the Company of the form of acceptance overleaf a binding contract will be created in respect of the order details of which are given overleaf and such contract shall not be subject to cancellation by the Purchaser although the Company reserves the right to cancel any order by refunding all monies paid upon receipt of an unsatisfactory survey report from its Surveyor. Without prejudice to its rights to claim damages for breach of contract the Company may at its sole discretion in appropriate cases agree to the cancellation of an order by the Purchaser upon the payment to the Company of all expenses incurred by it prior to the date of cancellation.
e) The company reserve the right to retain a reasonable amount of any deposit to cover the costs that we have incurred should the customer cancel the contract.
f) When payment is not made on the due date in accordance with this condition, the Company shall have the right to require payment of interest on the outstanding amount at a rate of 3% pa above the Bank Of England base rate from the due date until the date of actual payment.
Please Note:- In cases where the contract has been signed away from the company premises, the consumer may have a right of cancellation. Information regarding those cancellation rights can be supplied in a separate document.
4. Completion:
a) The Company will ensure that they shall complete the installation of the goods within a reasonable time.
b) The Client agrees to give free access to the Company installers to carry out installation of the Goods and shall ensure that such necessary rerouting of electrical and plumbing installations are carried out at the Clients own cost unless otherwise agreed by the Company in order that the installers can proceed to install the Goods.
5. Title of Goods:
Unless otherwise agreed in writing all materials delivered to the customer’s premises in connection with the work shall be at the customers risk after delivery, ownership of such materials shall pass to the customer once payment in full is received.
6. Damage:
The Company will ensure that all necessary action is taken to avoid damage to the Goods when installing the same and shall ensure that the installation is fitted in accordance with the specification outline in the drawings (unless caused by our negligence).
The Company will not however be responsible for any non-alignment of the install by reason of the installation being fitted on existing flooring at the customer’s request. Bluebell takes care when installing the Goods however the Client must take reasonable measures to protect existing flooring/decoration to prevent any damage.
In addition our fitters will dust sheet the designated area accordingly to minimize any dust, but must advise there will always be an unavoidable element of dust given we are completely bespoke and our furniture is scribed to the shape of your walls. Whilst every precaution will be taken to avoid damage to customers decorations, we cannot be held liable should this occur (with the exception of our own negligence)
7 Materials:
a) In the event that any installation requires a panel to be greater in length than is commercially available the company reserves the right to make a joint in the panel making good the same and in such circumstances the Client shall raise no complaint thereon.
b) Only items which are included on the contract/drawing will be supplied. Clients should not assume items such as shelves, mirrors; etc. will be supplied unless they are included in the contract. Any extras which the Client requests that are not shown on the plans will be subject to a charge and payment will need to be paid in full at the time of the order.
8 Alterations:
a) If the customer wishes to make alterations or additions to the design or specifications, then the customer must inform the Company in writing to: Bluebell Fitted Furniture, 81/83 Washway Road, Sale, Cheshire M33 7TQ or email to: reception@bluebellfittedfurniture.co.uk at least 28 days before the due installation date. Clients must be aware that this could delay the installation date. The cost of any alterations or additions out of this time scale will have to be borne in full by the Client.
b) Any changes to agreed installation dates must be advised 21 days prior in writing. The company reserves the right to charge a reasonable daily charge if we are unable to fill the installation date cancelled.
9 Guarantee:
a) Both workmanship and furniture (cabinet & doors) supplied by the Company are covered by a FIVE-YEARGUARANTEE subject to fair wear and tear. This warranty/guarantee does not restrict the customer’s rights under the Consumer Rights Act 2015 or affect your rights under any other statute. The warranty is not Insurance backed.
b) In addition to rights under the Consumer Rights Act 2015 all other items supplied fridges, freezers, washing machines, cookers, tap & sinks etc. are covered by manufacturers’ warranties. We strongly advise you to keep a record of all product documentation and register the warranty with the manufacturer If for any reason any monies are withheld without prior written agreement, then the above guarantee will become null and void.
Complaints policy
We always endeavour to provide the best service and products for our customers. However, on rare occasions, we recognize that there may be times where our customers may not be completely satisfied To ensure we can put things right as soon as we can, please read our complaints procedure below and we will respond promptly to ensure complete satisfaction As soon as possible after the completion of the works, please inspect the work to ensure everything has been carried out to our usual high standards In the unlikely event there is anything you are not completely satisfied with, please contact us as soon as you can in order that we can rectify any problems as soon as possible. M33 7TQ or email us at reception@bluebellfittedfurniture.co.uk and we will aim to respond within 14 days of receiving your complaint and where possible, will provide you with a date to remedy any issues raised.
Where we are unable to resolve your complaint using our own complaints procedure, as a Which Trusted Trader we use the Dispute Resolution Ombudsman for dispute resolution. In the unlikely event that we cannot remedy your complaint to your satisfaction you may wish to refer your complaint to them.
